Waiver of Public Hearing and Intent to Consider Third Reading

Pursuant to Section 464(2) and 467 of the Local Government Act, the requirement for a public hearing has been waived for proposed bylaw "Regional District of Nanaimo Land Use and Subdivision Amendment Bylaw No. 500.421, 2018" ("Bylaw 500.421"), because an Official Community Plan applies to the area that is subject to Bylaw 500.421 and the Regional District of Nanaimo Board of Directors considers this bylaw to be consistent with "Regional District of Nanaimo Electoral Area 'H' Official Community Plan Bylaw No. 1335, 2017".

Bylaw 500.421 affects the property located at 850, 860, 870 Spider Lake Road in Electoral Area H, legally described as Lot 10, Block 347, Newcastle and Alberni District, Plan 34021 (see map below) and received first and second reading at the July 24, 2018 Board meeting. The Regional District of Nanaimo is providing this notice of its intent to consider third reading of Bylaw 500.421 at a Special Board meeting to be held on Tuesday, September 4, 2018, at 3:00 pm in the Board Chambers located at 6300 Hammond Bay Road, Nanaimo, BC.

What is the Zoning Amendment about?

The purpose of Bylaw 500.421 is to rezone a portion of the subject property from Rural 1 (RU1) B to Rural 6 (RU6) D and another portion from Rural 1 (RU1) B to Rural 1 (RU1) CC, under the "Regional District of Nanaimo Land Use and Subdivision Bylaw No. 500, 1987", to facilitate a three lot subdivision.

A copy of the Amendment Bylaw and Board resolution waiving the Public Hearing, and other relevant documents may be inspected prior to the Board meeting at the Regional District of Nanaimo (RDN) office at 6300 Hammond Bay Road, Nanaimo. Office hours are Monday to Friday (excluding public holidays) 8:30 am to 4:30 pm, with extended business hours until 5:30 pm on Wednesdays.
