MOVED Director Stanhope, SECONDED Director Sherry, that the minutes of the regular Development Services Committee meeting held on April 18, 2000, be adopted.

UBCM, re 2000 Resolution Process.

MOVED Director Sherry, SECONDED Director Stanhope, that the correspondence from the Union of British Columbia Municipalities, regarding the 2000 resolution process, be received for information.

UNFINISHED BUSINESS

From the May 9, 2000 Board Meeting.

Director Sperling withdrew the following motion referred to the Development Services Committee meeting from the May 9, 2000 Board meeting:

That a 3 year moratorium be placed on the enforcement of building inspection infractions and a freeze be placed on proceeding on any outstanding legal actions on Gabriola Island to allow for the education of Gabriolans on building inspection and further, to not pursue recovery costs from building infractions through property taxes.

BUILDING INSPECTION

Section 700 Filings.

The Chairperson listed each filing and asked that any property owner in the audience wishing to address the Committee come forward when their name was called.

MOVED Director Stanhope, SECONDED Director Sherry, that a notice be filed against the titles of the properties listed, pursuant to Section 700 of the Municipal Act and that if the deficiencies are not rectified within ninety (90) days, legal action will be pursued:

  1. Lot 1, Section 24, Nanaimo District, Gabriola Island, Plan 23166, 175 James Way, Electoral Area �B�, owned by A. Fitzgerald and H. Sirlin;
  2. Lot 29, Sections 17 & 18, Range 3, Mountain District, Plan 26264, 3596 Ranch Point Road, Electoral Area �D�, owned by R. Douglas.

MOVED Director Haime, SECONDED Director Quittenton, that Development Permit Application No. 0008 submitted by Lantzville Properties Ltd. for the property legally described as Lot 1, District Lot 27-G, Wellington District, Plan 29352 be approved subject to conditions outlined in Attachment �5�, amended to include "Maintenance of pedestrian walkway located in front of parking area and at the side of the building", and the notification requirements pursuant to the Municipal Act.

MOVED Director Elliott, SECONDED Director Krall, that Development Variance Permit Application No. 0004 submitted by Crow & Gate Pub Limited for the property legally described as Lot 1, Section 9, Ranges 2 and 3, Cedar Land District, Plan 24930 be approved subject to conditions outlined in Schedule �1� and the notification requirements pursuant to the Municipal Act.

MOVED Director Haime, SECONDED Director Stanhope, that Development Variance Permit Application No. 0005 submitted by Vincent Iameo of Architrave on behalf of Gary Kingston and Judy Coursley, for the property legally described as Lot B, District Lot 54, Nanoose District, Plan VIP64750, to vary the minimum setback requirements of Section 6.3 8 a) i), which requires 18.0 m horizontal distance from a stream centerline to 8.5 m from the centerline of Stewart Creek to permit the construction of a residence on the property, be approved, subject to notification requirements pursuant to the Municipal Act.

Request for 10% Perimiter Frontage Relaxation � JE Anderson/D & S McGillivary and G & B Moxley � 1602, 1620, 1626 & 1630 Vowels Road � Area A.

MOVED Director Elliott, SECONDED Director Macdonald, that the request from JE Anderson and Associates, BCLS, on behalf of D & S McGillivery and G & B Moxley, to relax the minimum 10% perimeter frontage requirement for proposed Lot A as shown on the Plan of Proposed Subdivision of the Lots 6 and 7, Section 9, Range 3, Cranberry District, Plan 725 be approved.

Nanaimo Airport Parallel Taxiway Proposal � Area A.

MOVED Director McLean, SECONDED Director McNabb, that the Regional District of Nanaimo supports the proposed construction of an expanded parallel taxiway to improve the safety and efficiency of airport operations as proposed by the Nanaimo Airport Commission.
